2 JKLF Men Get Lifer For BSF Officer’s Murder

Srinagar: After 22 years of investigation and trial, a TADA court Monday convicted two JKLF men and awarded lifers to them for allegedly killing a BSF Inspector in 1990. Presiding Officer TADA court, Sanjeev Gupta, sentenced Nazir Ahmed Sheikh alias Gul Danter and Showkat Ahmed Khan alias Pup Waza to life imprisonment while Farooq Ahmed Chichoo was sentenced to five years rigorous imprisonment. After hearing Special Public Prosecutor ML Thusoo appearing for CBI and senior counsel Zaffar Ahmed Shah, Advocate KL Pandita and Yogesh Bakshi for the accused, the court convicted Nazir Ahmad Sheikh under section 302 of RPC and imposed a fine of Rs 5000. The court also sentenced him to undergo imprisonment for life and awarded a fine Rs 10,000 u-s 3 (2) (i) of TADA. The court also sentenced him to rigorous imprisonment for five years with a fine of Rs 5000 under section 4 of TADA apart from sentencing him to undergo rigorous imprisonment for seven years each under sections 25 & 27 for possessing illegal arms and ammunition and imposed a fine Rs 5000 on him. The court said that all the sentences would run concurrently. The court sentenced Showkat Ahmed Khan to imprisonment for life and a fine of Rs 5000 was imposed on him under section 302 RPC read with section 34 of RPC. Khan has also been sentenced to imprisonment for life and fined Rs 10,000 under sec 3 (2) (i) of TADA. He was further sentenced to rigorous imprisonment for five years with a fine of Rs 5000 under section 4 of TADA, besides he has to undergo RI for 10 years under section 364 RPC with a fine of Rs 7000. All the sentences shall run concurrently. The court awarded five years rigorous imprisonment to Farooq Ahmed Chichoo under section 3 (2) (ii) of TADA with a fine of Rs 3000. The court directed that the convicts shall be lodged in Central Jail Srinagar, adding till security arrangements are made for sending them to Srinagar, they shall be kept in District Jail Jammu. CASE HISTORY: According to the CBI, on October 26, 1990, a case was registered by Police Station Nishat Srinagar u-s 302 of RPC and 3-(2) of TADA (P) Act after getting information that some unknown person with intent to create terror fired at some unknown person and shot him dead leaving the body of the deceased lying on the road. According to CBI, SHO P-S Nishat reached the place of occurrence and body of the accused was sent for post-mortem and the body was declared as unidentified on October 27, 1990. According to the investigating agency, on the same day the Deputy Commandant 24th BN of BSF lodged a missing report with P-S Nishat regarding Dharamvir Sharma and on the basis of clothing and photographs of the body it was identified by the Deputy Commandant as the body of Inspector Dharamvir Sharma. The investigation of the case was transferred to CBI and after completion of investigation challan was presented in the court.
